1. Acceptance of Terms
1.1 Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "user") and Bield, LLC ("Bield," "we," "us," or "our") governing your access to and use of the Bield suite of applications and websites, including Bield Hunt, Bield Fish, and Bield Farm (collectively, the "Services").
By creating an account, downloading any Bield application, accessing any Bield website, or otherwise using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Services.
1.2 Defined Terms
Throughout these Terms, the following definitions apply:
"Services" means collectively all Bield applications (Bield Hunt, Bield Fish, and Bield Farm), websites (bieldhunt.com, bieldfish.com, and bieldfarm.com), and any related features, tools, APIs, content, or communications provided by Bield.
"Bield Hunt" means the pattern intelligence application for whitetail deer and turkey hunters.
"Bield Fish" means the pattern intelligence application for freshwater, river, and saltwater anglers.
"Bield Farm" means the pattern intelligence application for small and mid-size farm operators, homesteaders, and rural landowners.
"Account" means the registered user account you create to access the Services.
"Content" or "User Content" means all data, information, observations, catches, plantings, harvests, photographs, voice recordings, notes, drawings, and other materials you create, upload, or submit through the Services.
"Free Tier" means the no-cost access level available to all registered users, subject to the feature and usage limitations described in Section 4.1.
"Pro Subscription" or "Pro" means the paid subscription tier that provides full access to the Services as described in Section 4.2.
"Pattern Engine" means the proprietary algorithms and analytical tools within the Services that process User Content to identify patterns and generate insights.
"App Store" means the Apple App Store operated by Apple Inc.
"Play Store" means the Google Play Store operated by Google LLC.
"Lemon Squeezy" means the third-party payment platform used for web-based subscription purchases.
1.3 Eligibility
You must be at least 18 years of age to create an Account and use the Services independently. If you are between 13 and 17 years of age, you may only use the Services with the verifiable consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information without parental consent, we will promptly delete such information.
By using the Services, you represent and warrant that you meet the eligibility requirements described above, that you have the legal capacity to enter into a binding agreement, and that your use of the Services does not violate any applicable law or regulation.
1.4 Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice by one or more of the following methods: sending an email to the address associated with your Account, displaying a prominent notice within the Services, or posting a notice on the applicable website. Material changes will become effective no sooner than 30 days after such notice, except for changes required by law or changes to new features, which may be effective immediately.
Your continued use of the Services after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and may cancel your subscription as described in Section 4.6. We will maintain a record of prior versions of these Terms and make them available upon request.
2. Description of Services
2.1 General Description
Bield is a suite of personal pattern intelligence applications designed for serious hunters, anglers, and farm operators. Each Bield application captures personal observation and activity data entered by the user, automatically records environmental conditions at the time of each entry using approved third-party data sources, and applies statistical analysis to identify patterns specific to the user's properties, water bodies, or farm operations over multiple seasons. The core purpose of the Services is to help users understand what their own accumulated personal data reveals about their specific land and waters.
2.2 Product-Specific Descriptions
Bield Hunt is designed for whitetail deer and turkey hunters. The application enables users to log sits, sightings, and observations on specific properties and stand locations, with automatic capture of weather, moon phase, barometric pressure, and seasonal information. The Pattern Engine analyzes this data to identify conditions and stand combinations that have historically produced activity on the user's specific properties.
Bield Fish is designed for freshwater lake and pond anglers, river and stream anglers, and saltwater inshore and offshore anglers. The application enables users to log catches and fishing sessions with automatic capture of weather conditions, tide data, river flow rates, sea surface temperature, moon phase, and other environmental variables from approved data sources. The Pattern Engine analyzes this data to identify conditions, spots, species, and presentations that have historically produced results on the user's specific waters.
Bield Farm is designed for small and mid-size farm operators, homesteaders, market gardeners, and rural landowners. The application enables users to log crop plantings, harvests, inputs, soil tests, livestock records, breeding events, production data, grazing rotation, orchard events, tasks, and financial transactions per enterprise. The Pattern Engine analyzes this data to identify variety performance, field productivity, livestock performance trends, paddock productivity, and profit per enterprise across multiple seasons.
2.3 Platform Availability
The Services are available on the following platforms: iOS devices via the App Store, Android devices via the Play Store, and web browsers via the applicable Bield website. We do not guarantee that all features are available on all platforms. Platform availability may change at any time.
2.4 Service Nature and Limitations
The Services are tools that process your personal data to generate informational insights. The Services do not guarantee any particular outcome in hunting, fishing, or farming. Pattern recommendations are based solely on data you have entered and are not predictions of future conditions or results. The quality and accuracy of insights generated by the Pattern Engine is entirely dependent on the completeness and accuracy of the data you enter.
The Services are not a substitute for compliance with applicable hunting, fishing, or agricultural laws and regulations. The Services do not provide legal advice, agricultural advice, veterinary advice, or any other professional advice. Information about fishing and hunting regulations included in the Services may not be current and may contain errors. You are solely responsible for knowing and complying with all applicable regulations.
3. Account Registration
3.1 Account Creation
To access most features of the Services, you must create an Account. You may register using an Apple ID, a Google account, or an email address and password. You agree to provide accurate, complete, and current information during registration and to update such information to keep it accurate, complete, and current. You may not create an Account using a false identity or impersonate any person or entity.
3.2 Account Security
You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account, whether or not authorized by you. You agree to: (a) choose a strong, unique password if using email registration; (b) not share your credentials with any other person; (c) notify us immediately at support@bieldhunt.com (or the applicable product support address) if you discover or suspect unauthorized access to your Account; and (d) ensure you log out of your Account after each session on shared devices.
We are not liable for any loss or damage arising from your failure to comply with these security obligations.
3.3 One Account Per User
Each person may maintain only one Account. Creating multiple Accounts to circumvent Free Tier limitations or for any other purpose is prohibited and may result in termination of all associated Accounts.
3.4 Account Suspension and Termination
We reserve the right to suspend or terminate your Account, with or without notice, for any of the following reasons: (a) violation of these Terms; (b) conduct that we reasonably determine to be harmful to other users, third parties, or our legitimate business interests; (c) conduct that may expose Bield to legal liability; (d) extended inactivity as described in Section 3.6; or (e) as required by applicable law or court order.
Termination of your Account for cause does not entitle you to any refund of prepaid subscription fees. Termination of your Account without cause may entitle you to a prorated refund at our discretion, subject to the refund policies of the applicable payment processor.
3.5 User-Initiated Account Deletion
You may delete your Account at any time through the Settings section of the applicable Bield application. Account deletion initiates the data deletion process described in our Privacy Policy. Deletion is permanent and irreversible after the grace period described in our Privacy Policy.
3.6 Inactive Accounts
Accounts with no login activity for 24 consecutive months may be flagged for deletion. We will send a notice to the email address associated with your Account at least 30 days before taking any action. You may reactivate your Account by logging in at any time before deletion.
4. Subscription and Payment Terms
4.1 Free Tier
All registered users have access to a Free Tier at no cost. The Free Tier is subject to the following limitations, which differ by product:
Bield Hunt Free Tier: Limited to one property, three stand or location markers, fifteen lifetime observations, and no access to the Pattern Engine, multi-season data comparison, or data export.
Bield Fish Free Tier: Limited to one water body, three spot markers, fifteen lifetime catch records, three lifetime session records, three lifetime AI photo identifications, and no access to the Pattern Engine, all aquatic environments, or data export.
Bield Farm Free Tier: Limited to one field, five lifetime planting records, five lifetime animal records, five lifetime perennial records, three lifetime AI photo identifications, and no access to the Pattern Engine, financial tracking, grazing rotation tracking, soil test history, multi-season comparison, or data export.
We reserve the right to modify the Free Tier limitations at any time with reasonable notice. Changes to Free Tier limitations will not affect data already entered by existing users.
4.2 Pro Subscription Tiers
Full access to the Services is available through a Pro Subscription at the following rates:
Bield Hunt Pro: $7.99 per month or $49.99 per year. Bield Fish Pro: $7.99 per month or $49.99 per year. Bield Farm Pro: $9.99 per month or $69.99 per year.
Pro Subscriptions provide unlimited access to all features available on the applicable platform, including the Pattern Engine, unlimited data entry, multi-season data comparison, and data export. Features may vary by platform and may be updated over time.
4.3 Auto-Renewal — IMPORTANT DISCLOSURE
All Pro Subscriptions automatically renew at the end of each subscription period (monthly or annual, as applicable) at the then-current subscription price, unless you cancel at least 24 hours before the end of the current period.
For subscriptions purchased through the Apple App Store: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period. You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings at any time after purchase. Visit Settings > [Your Name] > Subscriptions on your iOS device, or visit appleid.apple.com.
For subscriptions purchased through the Google Play Store: Your Google account will be charged for renewal at the applicable price within 24 hours prior to the end of the current subscription period. You can manage your subscription and cancel auto-renewal through the Google Play Store app or at play.google.com/subscriptions.
For subscriptions purchased through Lemon Squeezy (web): Your payment method on file will be charged for renewal at the applicable price at the end of each subscription period. You can manage and cancel your subscription through your account settings on the applicable Bield website or by contacting support@bieldhunt.com.
Cancellation of a subscription stops future renewals but does not provide a refund for the current subscription period, except where refunds are required by applicable law or provided at our discretion.
4.4 Free Trials
We may offer free trial periods for Pro Subscriptions from time to time. The terms and duration of any free trial will be disclosed at the time of offer. If you do not cancel before the end of the free trial period, you will be automatically charged for the applicable Pro Subscription. Only one free trial is permitted per user per product. We reserve the right to modify, cancel, or limit free trial eligibility at any time.
4.5 Payment Processing
All payments are processed by the applicable payment processor: Apple Inc. for App Store purchases, Google LLC for Play Store purchases, or Lemon Squeezy for web purchases. We do not receive or store your credit card number, bank account information, or other sensitive payment credentials. Your use of these payment processors is subject to their respective terms of service and privacy policies. We are not responsible for payment processor errors, fraud, or system outages.
For App Store and Play Store purchases, the payment processor's refund policies apply. For web purchases through Lemon Squeezy, refund requests must be submitted within 14 days of the charge and are evaluated on a case-by-case basis. We reserve the right to deny refunds for abuse of the refund process.
4.6 Price Changes
We reserve the right to change subscription prices at any time. For existing subscribers, price changes will not take effect until the next renewal date. We will provide at least 30 days advance notice of any price increase via email to your registered address. If you do not cancel your subscription before the price change takes effect, you will be deemed to have accepted the new price.
4.7 Taxes
Subscription prices may not include applicable taxes. We may be required to collect and remit sales tax, value-added tax, goods and services tax, or similar taxes depending on your jurisdiction and the nature of the transaction. Any applicable taxes will be disclosed at the time of purchase or shown on your receipt.
5. User Content and Data Ownership
5.1 You Own Your Data
You retain full ownership of all User Content you create, upload, or submit through the Services. We do not claim any ownership interest in your User Content. Your hunting observations, fishing catches, farm records, field boundaries, animal data, financial records, photographs, voice notes, and all other data you enter belong to you.
5.2 License You Grant to Bield
By submitting User Content through the Services, you grant Bield a limited, non-exclusive, royalty-free, worldwide license to use, store, process, display, reproduce, and distribute your User Content solely for the purpose of providing the Services to you. This license includes the right to: (a) store your Content on our servers and backup systems; (b) transmit your Content across our infrastructure and to approved third-party processors as described in our Privacy Policy; (c) process your Content through the Pattern Engine to generate insights; (d) display your Content within the Services on your devices; and (e) format and adapt your Content for compatibility across platforms.
This license does not permit us to: (a) sell your User Content; (b) share your User Content with other users without your consent; (c) use your User Content for purposes other than providing the Services to you; or (d) use your User Content to train machine learning models or artificial intelligence systems, except for anonymized aggregate data that cannot identify you, as described in Section 5.4.
This license terminates when you delete the applicable User Content or close your Account, subject to the backup retention period described in our Privacy Policy.
5.3 Your Representations About Your Content
By submitting User Content, you represent and warrant that: (a) you have all rights necessary to grant the license described in Section 5.2; (b) your User Content does not infringe any copyright, trademark, trade secret, or other intellectual property right of any third party; (c) your User Content does not violate any applicable law or regulation, including but not limited to laws governing hunting, fishing, or agricultural activity; and (d) your User Content does not contain any material that is defamatory, obscene, or otherwise unlawful.
5.4 Aggregated and Anonymized Data
We may use data derived from User Content in aggregated, anonymized form that cannot reasonably be used to identify any individual user for the following limited purposes: improving the Services, developing new features, conducting research on general patterns, and producing aggregate statistics about the Services. This anonymized data does not constitute your personal data and is not subject to the ownership or license restrictions described above. We will never use location data tied to identifiable users for aggregate purposes.
5.5 Data Export
Pro Subscribers have the ability to export their User Content in CSV format from within the applicable Bield application. We will also provide a data export in machine-readable format upon written request to the applicable privacy email address, regardless of subscription status, as required by applicable law. We will fulfill reasonable export requests within 30 days.
6. Acceptable Use Policy
6.1 General Prohibited Uses
You agree not to use the Services to:
(a) Violate any applicable federal, state, local, or international law or regulation, including but not limited to laws governing hunting, fishing, agriculture, environmental protection, data privacy, or computer access;
(b) Engage in any activity that constitutes poaching, illegal taking of game or fish, trespassing, or any other violation of fish and wildlife laws;
(c) Log observations, catches, or records related to illegally taken animals, fish, or farm products;
(d) Impersonate or attempt to impersonate Bield, a Bield employee, another user, or any other person or entity;
(e) Transmit any unsolicited or unauthorized advertising, promotional material, or spam;
(f) Attempt to gain unauthorized access to any portion of the Services, any other accounts, or any computer systems or networks connected to the Services;
(g) Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our prior written permission;
(h) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Services;
(i) Circumvent, disable, or interfere with security-related features of the Services, including features that prevent or restrict use or copying of any Content;
(j) Circumvent Free Tier limitations by creating multiple Accounts;
(k) Sell, transfer, or sublicense your Account or subscription to any third party;
(l) Use the Services in any way that could damage, disable, overburden, or impair the Services or interfere with any other party's use;
(m) Upload or transmit any viruses, Trojan horses, or other malicious code;
(n) Collect or harvest any personally identifiable information from the Services without authorization;
(o) Use the Services for any commercial purpose not expressly authorized by Bield in writing; or
(p) Encourage or enable any other individual to engage in any of the above-described activities.
6.2 Bield Hunt — Additional Restrictions
In addition to the general prohibitions above, you specifically agree not to use Bield Hunt to:
(a) Log observations of other hunters, their vehicles, or their property without their knowledge or consent;
(b) Use GPS location data from the application to identify, access, or hunt on land owned by others without authorization;
(c) Record observations of any animal taken in violation of applicable game laws or regulations; or
(d) Use the application as a tool for poaching coordination or communication.
6.3 Bield Fish — Additional Restrictions
In addition to the general prohibitions above, you specifically agree not to use Bield Fish to:
(a) Log catches of fish taken in violation of size limits, bag limits, season restrictions, or any other applicable fishing regulation;
(b) Use GPS and spot data to access private water or fishing areas without authorization; or
(c) Record catches made using illegal methods, gear, or substances.
6.4 Bield Farm — Additional Restrictions
In addition to the general prohibitions above, you specifically agree not to use Bield Farm to:
(a) Record pesticide applications, treatments, or practices that violate EPA regulations, state agricultural laws, or worker safety laws;
(b) Use the financial tracking features as your sole system of record for regulatory compliance filings;
(c) Use the application as a substitute for required government reporting, licensing, or documentation; or
(d) Record animal health treatments or medications in violation of veterinary prescription requirements.
6.5 Content Standards
All User Content you submit must comply with the following standards. Content must not: (a) be false, inaccurate, or misleading; (b) violate any third-party intellectual property rights; (c) violate any applicable law; or (d) be harmful to minors in any respect.
6.6 Enforcement
We reserve the right, but do not have the obligation, to: (a) monitor User Content for compliance with these Terms; (b) investigate any reported or suspected violation of these Terms; (c) take appropriate legal action against anyone who violates these Terms; (d) remove or refuse to display any User Content that violates these Terms; and (e) suspend or terminate Accounts that violate these Terms.
7. Intellectual Property
7.1 Bield's Intellectual Property
The Services, including all software, algorithms, designs, graphics, text, images, and other content created by Bield (excluding User Content), are owned by Bield and are protected by United States and international intellectual property laws. The following are trademarks of Bield, LLC: Bield, Bield Hunt, Bield Fish, and Bield Farm. You may not use any Bield trademark without prior written permission.
The Pattern Engine and all associated algorithms are proprietary to Bield. You may not copy, reverse engineer, decompile, disassemble, or create derivative works based on the Pattern Engine or any other proprietary technology included in the Services.
7.2 Limited License to Users
Subject to your compliance with these Terms, Bield grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial purposes. This license does not include the right to: (a) copy or reproduce any part of the Services; (b) modify or create derivative works; (c) distribute, sell, or sublicense the Services; (d) publicly display or perform the Services; or (e) reverse engineer the Services.
7.3 Third-Party Intellectual Property
The Services incorporate data, software, and services from third parties that are subject to their own intellectual property rights and terms of service. By using the Services, you acknowledge that applicable third-party terms govern your use of the following: Apple WeatherKit data (subject to Apple's terms); Mapbox mapping services and data (subject to Mapbox's terms); NOAA Tides and Currents data (Bield Fish; public domain U.S. government data with attribution requirements); USGS Water Services data (Bield Fish; public domain U.S. government data); NOAA CoastWatch sea surface temperature data (Bield Fish; public domain U.S. government data); and Anthropic Claude AI services (Bield Fish and Bield Farm photo identification; subject to Anthropic's usage policies).
7.4 Feedback
If you provide any suggestions, ideas, enhancement requests, feedback, or other information about the Services ("Feedback"), you grant Bield an unrestricted, perpetual, irrevocable, royalty-free license to use such Feedback in any manner, including to improve the Services or develop new products, without any obligation to compensate you or provide attribution. Feedback does not include personal data governed by our Privacy Policy.
7.5 Copyright Infringement Claims
If you believe that any Content on the Services infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) to our designated agent:

Your notification must include: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing, with information sufficient for us to locate it; (d) your contact information; (e) a statement that you have a good faith belief that the use is not authorized; and (f) a statement under penalty of perjury that the information is accurate and you are authorized to act.
We will respond to valid DMCA notices and, in appropriate circumstances, will disable access to infringing content and terminate the Accounts of repeat infringers.
8. Privacy and Data Handling
Your privacy is critically important to us. Our Privacy Policy, available at bieldhunt.com/privacy, bieldfish.com/privacy, and bieldfarm.com/privacy, describes in detail how we collect, use, store, share, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference and constitutes a binding part of the agreement between you and Bield.
By using the Services, you acknowledge that you have read and understood our Privacy Policy. If you do not agree with our Privacy Policy, you may not use the Services.
Key privacy principles that apply to all Bield products:
- We do not sell your personal data to any third party, ever.
- Your hunting observations, fishing catches, and farm records belong to you.
- We do not share your property locations, water body locations, or field boundaries with other users or third parties.
- We use your data only to provide the Services to you and as described in the Privacy Policy.
9. Third-Party Services and Integrations
9.1 Disclosure of Third-Party Services
The Services depend on and interact with the following third-party services. Your use of the Services involves the transmission of certain data to these providers as described in our Privacy Policy:
Apple WeatherKit — provides weather data including temperature, wind speed, barometric pressure, and humidity captured at the time of user-initiated logging events.
Mapbox — provides mapping, satellite imagery, and geographic data displayed within the Services.
NOAA Tides and Currents API (Bield Fish only) — provides tide predictions and real-time tide data for saltwater fishing sessions.
USGS Water Services API (Bield Fish only) — provides river gauge data including current flow rate and water level.
NOAA CoastWatch ERDDAP (Bield Fish only) — provides sea surface temperature data for offshore fishing sessions.
Anthropic Claude (Bield Fish and Bield Farm) — provides AI-powered photo identification for fish species (Bield Fish) and crop, plant, and animal identification (Bield Farm). When you use the photo identification feature, the photograph you submit is transmitted to Anthropic's API for processing.
Apple App Store — processes subscription purchases and manages subscription status for iOS users.
Google Play Store — processes subscription purchases and manages subscription status for Android users.
Lemon Squeezy — processes subscription purchases for web users.
Supabase — provides database storage, authentication, and backend infrastructure for the Services.
Sentry — provides error tracking and crash reporting to help us identify and fix application bugs.
9.2 Third-Party Terms and Policies
Each of the above third-party services has its own terms of service and privacy policy, which govern that provider's handling of data transmitted to them. We encourage you to review these terms. We are not responsible for the data practices, errors, service interruptions, or policy changes of any third-party provider.
9.3 Government Data Sources
Data obtained from NOAA and USGS is provided by the United States federal government and is made available as public information. This data is provided as-is and may contain errors, delays, or gaps. We do not guarantee the accuracy, completeness, or timeliness of government-sourced data. You should verify critical decisions against official government sources.
9.4 Hunting and Fishing Regulation Information
Any hunting or fishing regulation information displayed within the Services is provided for informational purposes only. Regulations change frequently. We do not guarantee that such information is current, complete, or accurate for your specific jurisdiction. You are solely responsible for knowing and complying with all applicable regulations. Always verify regulatory information with the applicable state wildlife agency before engaging in any hunting or fishing activity.
9.5 Third-Party Service Interruptions
Bield is not responsible for interruptions, errors, or outages in third-party services. Interruption of a third-party service may result in reduced functionality within the Services, including but not limited to unavailability of weather data capture, mapping features, tide and flow data, or AI photo identification. Such interruptions do not constitute a breach of these Terms and do not entitle you to a refund.
10. Disclaimers and Warranties
10.1 No Warranty
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIELD EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10.2 No Warranty of Results
Bield does not warrant that the Services will meet your requirements, that the Services will be uninterrupted, timely, secure, or error-free, that the results obtained from using the Services will be accurate or reliable, or that defects in the Services will be corrected. We make no representation that using the Services will improve your hunting success, fishing success, or farm productivity.
10.3 No Professional Advice
Nothing in the Services constitutes legal advice, agricultural advice, veterinary advice, financial advice, or any other form of professional advice. You should consult licensed professionals before making decisions about your farming operations, animal health, pesticide applications, or any other matter requiring professional expertise.
10.4 Inherent Activity Risks
Hunting, fishing, and farm operations involve inherent risks of personal injury, property damage, and death. These risks exist regardless of whether you use the Services. Bield does not assume any responsibility for injuries, accidents, losses, or damages that occur in connection with your hunting, fishing, or farming activities. You acknowledge and accept all risks inherent in these activities.
10.5 Content Accuracy
We do not verify the accuracy or completeness of User Content submitted by users. Content generated by the Pattern Engine is based on user-submitted data and third-party data sources that may contain errors. We do not warrant the accuracy of any Pattern Engine output.
10.6 Beta Features
From time to time, we may offer features on a beta or preview basis. Such features are provided without warranty of any kind and may be modified or discontinued at any time without notice.
10.7 State Law Provisions
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.
11. Limitation of Liability
11.1 Exclusion of Consequential Damages
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BIELD, ITS OWNERS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS, LOSS OF GOODWILL, LOSS OF HUNTING OR FISHING LICENSES, LOSS OF CROPS OR LIVESTOCK, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF BIELD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.2 Aggregate Liability Cap
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIELD'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO BIELD FOR SUBSCRIPTIONS IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) $100.00 USD.
11.3 Essential Basis of Bargain
You acknowledge that the limitations of liability set forth in this Section 11 are an essential element of the agreement between you and Bield. Bield would not provide the Services at the prices charged without these limitations.
11.4 State Law Exceptions
Some states do not allow limitation of liability for personal injury or for incidental or consequential damages in certain circumstances. In such states, our liability will be limited to the maximum extent permitted by applicable law.
12. Indemnification
12.1 Your Indemnification Obligations
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Bield and its owners, employees, contractors, agents, licensors, suppliers, successors, and assigns (collectively, "Bield Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) Your use of or inability to use the Services;
(b) Your User Content, including any claim that your User Content violates the intellectual property rights, privacy rights, or other rights of any third party;
(c) Your violation of these Terms;
(d) Your violation of any applicable law, regulation, or third-party right, including without limitation any hunting, fishing, or agricultural regulation;
(e) Any injury, accident, loss, or damage occurring during any hunting, fishing, or farming activity, regardless of any connection to the Services;
(f) Any claim brought by a third party arising out of your conduct or use of the Services; or
(g) Your fraud, willful misconduct, or gross negligence.
12.2 Indemnification Procedure
Bield will promptly notify you of any claim for which indemnification is sought. Bield reserves the right to assume exclusive control of the defense of any claim at your expense. You agree to cooperate fully with our defense of any claim. You may not settle any claim without our prior written consent if such settlement imposes any obligation or restriction on Bield.
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to any conflict of law principles that would result in the application of the laws of any other jurisdiction.
13.2 Informal Dispute Resolution
Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute informally. You must notify us in writing at legal@bieldhunt.com, describing the nature of the dispute and the relief you seek. We will attempt to resolve the dispute within 30 days of receipt of your notice. If the dispute is not resolved within 30 days, either party may proceed with formal legal action as described below.
13.3 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a "Dispute") shall be finally resolved by binding individual arbitration. You and Bield each waive the right to a trial by jury and the right to participate in a class action or class arbitration.
Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration will be conducted in English and, unless otherwise required by the AAA rules, will take place in Richmond, Virginia or, at your election, via telephone or video conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
The arbitrator may award any relief that a court could award, including individual injunctive relief, but may not award relief that affects persons other than you and Bield. The arbitrator shall apply the substantive law of Virginia and applicable federal law.
Payment of arbitration fees shall be governed by the AAA Consumer Arbitration Rules. We will pay any arbitration fees required for claims of $10,000 or less. For claims above $10,000, fees shall be allocated per the AAA rules.
13.4 Class Action Waiver
YOU AND BIELD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. IF THIS WAIVER IS FOUND UNENFORCEABLE AS TO ANY CLAIM, THEN THAT CLAIM MUST BE SEVERED FROM ARBITRATION AND LITIGATED IN COURT PURSUANT TO SECTION 13.5.
13.5 Exceptions to Arbitration
Notwithstanding Section 13.3, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to preserve the status quo pending arbitration, including to protect intellectual property rights. Nothing in these Terms prevents you from filing a complaint with a government agency or exercising rights under applicable consumer protection laws. Either party may bring small claims court actions in lieu of arbitration for claims within the jurisdictional limits of such courts.
13.6 Opt-Out of Arbitration
You may opt out of the binding arbitration requirement by sending written notice to legal@bieldhunt.com within 30 days of the date you first create your Account. Your notice must include your name, Account email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved as described in Section 13.7.
13.7 Litigation Fallback
If you properly opt out of arbitration, or if the arbitration agreement is found unenforceable, any Dispute shall be resolved exclusively in the state or federal courts located in Henrico County, Virginia. You and Bield each consent to the personal jurisdiction and venue of such courts.
13.8 Time Limitation on Claims
Any claim arising out of or related to these Terms or the Services must be brought within one (1) year after the cause of action arises. Claims not brought within this period are permanently barred, even if the applicable statute of limitations has not expired.
14. App Store and Play Store Terms
14.1 Apple App Store — Required Disclosures
If you download or access a Bield application through the Apple App Store, the following additional terms apply:
(a) These Terms are between you and Bield only, not Apple Inc. Apple is not a party to these Terms.
(b) Apple has no obligation whatsoever to provide any maintenance, support, or warranty services with respect to Bield applications.
(c) Apple is not responsible for addressing any claims you or any third party may have relating to the Bield applications, including product liability claims, consumer protection claims, intellectual property infringement claims, or any claim that the application fails to conform to any applicable legal or regulatory requirement.
(d) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms with respect to your license of the Bield application. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
(e) Your use of the Bield application must comply with the Apple App Store Terms of Service.
(f) Any questions or complaints regarding the Bield application should be directed to us at support@bieldhunt.com, not to Apple.
14.2 Google Play Store — Required Disclosures
If you download or access a Bield application through the Google Play Store, the following additional terms apply:
(a) These Terms are between you and Bield only, not Google LLC. Google is not a party to these Terms.
(b) Your use of the Bield application must comply with the Google Play Terms of Service and applicable usage policies.
(c) Google Play subscription and payment policies govern all transactions made through the Play Store.
14.3 Pre-Release Software
If you access a Bield application through Apple TestFlight, the Google Play internal testing track, or any other pre-release channel, you acknowledge that: (a) the software is pre-release and may contain errors, bugs, and incomplete features; (b) no warranty of any kind is provided for pre-release software; (c) you may be asked to maintain confidentiality about pre-release features; and (d) pre-release access may be revoked at any time without notice.
15. Website-Specific Terms
15.1 Website Access
Access to Bield websites (bieldhunt.com, bieldfish.com, bieldfarm.com) does not require an Account. By accessing any Bield website, you agree to these Terms. We reserve the right to restrict, suspend, or terminate website access at any time for any reason.
15.2 Blog Content
Blog content published on Bield websites is provided for informational purposes only. Such content reflects the views of the authors and does not constitute professional advice of any kind. We make reasonable efforts to ensure the accuracy of blog content, but we do not warrant its accuracy, completeness, or currency. Blog content may be updated, modified, or removed at any time.
15.3 Email Newsletter
If you subscribe to a Bield email newsletter, you consent to receive periodic emails containing content, updates, and information about the Services. You may unsubscribe at any time by clicking the unsubscribe link included in each newsletter email or by emailing the applicable support address. We comply with the CAN-SPAM Act and applicable email marketing laws. Canadian subscribers have additional rights under CASL.
15.4 Contact Form Submissions
Information submitted through Bield website contact forms is used to respond to your inquiry and for no other purpose without your consent. We retain contact form submissions for two years from the date of submission for customer service purposes.
15.5 Hyperlinks
Bield websites may contain links to third-party websites for your convenience. These links do not constitute an endorsement of the linked website or its content. We have no control over the content, privacy practices, or availability of linked third-party websites and are not responsible for any harm resulting from your access to or use of them.
15.6 Regulation Information Pages
Information displayed on any state-specific regulation pages within Bield websites is provided for general informational purposes only. This information may be outdated, incomplete, or inaccurate. Hunting and fishing regulations are subject to frequent change. Always verify current regulations directly with the applicable state wildlife management agency before engaging in any regulated activity. Bield assumes no liability for errors or omissions in regulation information.
16. International Users
16.1 Geographic Scope
The Services are designed and operated from the United States and are intended primarily for users in the United States. We do not represent that the Services are available or appropriate in other jurisdictions. Access from outside the United States is at your own risk, and you are responsible for compliance with local laws.
16.2 Export Compliance
You may not use, export, or transfer the Services in violation of U.S. export laws and regulations, including the Export Administration Regulations. You represent and warrant that you are not located in any jurisdiction subject to U.S. economic sanctions and that you are not on any U.S. government restricted party list.
16.3 European Union Users — GDPR
If you are located in the European Economic Area, United Kingdom, or Switzerland, additional rights apply to your personal data as described in our Privacy Policy. You may contact us regarding GDPR-specific matters at privacy@bieldhunt.com.
16.4 California Residents — CCPA/CPRA
If you are a California resident, additional rights apply to your personal data as described in our Privacy Policy, including the rights described under the California Consumer Privacy Act and the California Privacy Rights Act.

17. Miscellaneous
17.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Bield with respect to the Services and supersede all prior agreements, understandings, and communications, whether written or oral, between you and Bield relating to the Services.
17.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17.3 No Waiver
The failure of Bield to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Waivers must be in writing signed by an authorized representative of Bield to be effective.
17.4 Assignment
You may not assign or transfer these Terms or any rights or obligations under these Terms without the prior written consent of Bield. Bield may assign or transfer these Terms, in whole or in part, without restriction and without notice, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.
17.5 Force Majeure
We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by events beyond our reasonable control, including without limitation natural disasters, pandemics, war, terrorism, civil disturbances, internet outages, power failures, telecommunications failures, third-party service disruptions, or government actions.
17.6 Notices
All notices to Bield under these Terms must be sent in writing to legal@bieldhunt.com. We may provide notices to you by email to your registered address, by posting to the Services, or by other reasonable means. Notices are deemed received when sent to the email address on file or when posted within the Services.
17.7 Headings
Section headings are included for convenience only and will not affect the interpretation of these Terms.
17.8 Relationship of the Parties
These Terms do not create a partnership, joint venture, employment relationship, or agency relationship between you and Bield. Neither party has the authority to bind the other without the other party's prior written consent.
17.9 Survival
The following provisions will survive termination of these Terms for any reason: Section 5 (User Content), Section 7 (Intellectual Property), Section 10 (Disclaimers), Section 11 (Limitation of Liability), Section 12 (Indemnification), Section 13 (Dispute Resolution), and Section 17 (Miscellaneous).
17.10 Language
These Terms are written in English. In the event of any conflict between an English version and a translated version of these Terms, the English version will control.
